The Benefit Art Auction is special fundraising event for artists and art collectors to support the LAC by donating works of art.
All works donated will be displayed at the LAC in a bid or buy now style auction exhibition.
Donors will receive a charitable income tax donation receipt for the full realized sold price of their donated artwork.
100% of the proceeds of the auctioned artwork will be used to support the LAC, its community programs and activities.
Eligibility & Terms
This exhibit is open to all artists, collectors, and general art enthusiasts who wish to support the LAC by donating artwork to this fundraising exhibition.
Only 2D & 3D works of art will be accepted. Crafts, antiques, and collectibles will not be accepted.
Artwork that is damaged, decayed and not in suitable condition for hanging and display will not be accepted.
Artwork may be in any style, medium, subject matter and age.
How it Works
A starting bid and a buy now price will be determined by the LAC based on fair market value estimations with consideration and aim to sell.
Charitable tax receipts will be issued to donors for the realized sold price (how much the artwork actually sells for) at the end of the exhibition.
Artwork that is SOLD in the auction shall be binding to this gift agreement and the sold amount.
Artwork that is UNSOLD at auction shall be assessed and a fair market value offer presented to the donor. Upon acceptance, the artwork shall become the property of the South Essex Arts Association/Leamington Arts Centre. In the event a fair market value offer cannot be agreed upon, the artwork shall be available for pick up by the donor and the gift agreement herein shall become null and void.
How to Submit
Complete this online form and deliver the listed artwork to the LAC before the submission deadline. Incomplete or late submissions will not be considered.
Submission Fee
There is no fee to donate artwork to the benefit art auction.
Delivery
Delivery of artwork is the donor/trustee's responsibility. All work must be delivered on or before the date listed in the schedule. Loading Zone parking is located directly in front of the gallery.

The SEAA/LAC will recognize your generosity as we add your gift into our Benefit Art Auction and issue a charitable donation tax receipt for the full sold amount of the artwork donated.
We intend, by this gift, to create a donor/donee relationship. Interpretation of this Agreement is subject to the laws of the Province of Ontario.
Should modification of this agreement be necessary, any amendment shall be made in writing and signed by both parties.
This agreement constitutes our full, mutual understanding concerning this gift. There are no other agreements or expectations. We confirm our common understanding that this is a binding gift on you and your estate.
Also, we appreciate your understanding that this gift does not limit the South Essex Arts Association’s exclusive discretion to determine the contents of its programs and exhibitions or to interpret its mission or allow the South Arts Association’s and Leamington Arts Centre’s name, logo, and trademark to be used in any manner. The South Essex Association, as a public Not-For-Profit Organization may disclose the terms of this gift, including this agreement, if requested by any interested party. The South Essex Arts Association confirms, for Canada Revenue Agency the details for the purposes and conditions of this gift. You may not transfer to another the recognition of your generosity that the South Essex Arts Association has agreed to provide. Artwork that is unsold at auction shall be assessed and a fair market value offer presented to the donor. Upon acceptance, the artwork shall become the property of the South Essex Arts Association/Leamington Arts Centre.
In the event a fair market value offer cannot be agreed upon, the artwork shall be available for pick up by the donor/trustee. The LAC/SEAA reserves the right in its sole discretion to disclude any work it feels does not meet the exhibition eligibility criteria, size accommodations or any work it feels is inappropriate for all audience and could otherwise be considered offensive or overly sexualized in nature.
Uncollected work after 1 year of the exhibit end will become the property of the Leamington Arts Centre. We strongly advise to collect unsold works within the pick up times in the exhibition schedule. Unclaimed works may be sold and all proceeds forfeited by the donor. The LAC reserves the right to close the submissions early.
These terms and conditions contain legal obligations. Please read these terms and conditions carefully before submitting to this exhibition.
LIMITATION OF LIABILITY: I/we hereby agrees to hold the South Essex Arts Association/Leamington Arts Centre, its committees, their officers, directors, employees and volunteers, and the Corporation of the Municipality of Leamington, harmless from any and all damage, expense or liability from any injury or damage (financial, physical or otherwise) to any person, including the general public, the donor/trustee, its agents or employees or to the property of the donor/trustee arising out of the donor/trustee's participation in the exhibition.
The South Essex Arts Association/Leamington Arts Centre will not be responsible for any loss or losses incurred by the donor/trustee, as a result of fire, theft, water, accidents, weather, acts of God or other mishaps or incidents not specifically enumerated herein. Recognizing that this exhibition is run by a not-for-profit charitable organization, the donor/trustee assumes all risks and responsibilities in participating in this event including any liability and assumptions made in determination of fair market value and the sale of any artwork.
All sales and donations are final.
